STORY SUBMISSION RELEASE
By submitting any story, message, voicemail, audio recording, text message, email, written statement, photograph, video, file, comment, or other material in connection with If You Should Leave Before Me (collectively, the “Submission”), I hereby agree as follows:
1. Grant of Rights
I irrevocably grant to If You Should Leave Before Me, LLC, its parents, subsidiaries, affiliates, members, managers, officers, employees, contractors, licensees, successors, assigns, distributors, advertising and promotional partners, and any parties acting with its authority or permission (collectively, the “Company”), the worldwide, perpetual, irrevocable, royalty-free, fully paid-up, transferable, sublicensable right and license to use, reproduce, record, edit, modify, adapt, translate, publish, display, perform, distribute, exhibit, transmit, broadcast, stream, digitize, archive, create derivative works from, and otherwise exploit my Submission, in whole or in part, in any and all media now known or later developed.
This grant includes, without limitation, the right to use my Submission in connection with the motion picture currently entitled If You Should Leave Before Me (the “Picture”), and in any related advertising, publicity, marketing, promotional materials, social media content, websites, trailers, teasers, behind-the-scenes content, educational materials, press materials, bonus materials, companion materials, and any other materials related to the Picture, the Company, or the campaign.
2. Voice, Name, Likeness, and Personal Attributes
If my Submission includes my voice, image, likeness, name, initials, social media handle, biographical information, personal story, personal experiences, or any other identifying characteristic, I grant the Company the right to use such materials and attributes in connection with the Submission and the Picture.
If my Submission is a voicemail or audio recording, I specifically authorize the Company to use my actual voice, recording, words, tone, and performance, in whole or in part, including edited excerpts.
If my Submission is written, including by text message, email, online form, comment, or other written method, I specifically authorize the Company to use the words, phrases, ideas, themes, emotions, and story elements contained in the Submission, in whole or in part, including edited excerpts.
3. Editing and Creative Use
I understand and agree that the Company may edit, shorten, rearrange, modify, adapt, dramatize, fictionalize, combine with other material, or otherwise alter my Submission, provided the Company has no obligation to use the Submission in any particular manner or at all.
I understand that my Submission may be used out of context, in excerpted form, or alongside other materials, and I waive any right to inspect or approve any use of the Submission or any finished materials that include or are inspired by the Submission.
4. No Compensation or Ownership
I understand and agree that I will not receive any payment, credit, compensation, royalties, ownership interest, approval rights, accounting, or other consideration in connection with the Submission or any use of the Submission.
I acknowledge that the Company will exclusively own all materials created by or for the Company that incorporate, adapt, are inspired by, or are based upon the Submission, including any edited versions, derivative works, promotional materials, and final productions.
5. No Obligation to Use
I understand that the Company is not required to use, publish, feature, respond to, preserve, return, or acknowledge my Submission. The Company may remove, delete, archive, or decline to use any Submission at any time for any reason.
6. Representations and Warranties
I represent and warrant that:
- I am at least eighteen (18) years old, or I have the consent of my parent or legal guardian to make this Submission;
- The Submission is truthful to the best of my knowledge, or reflects my honest memory, feelings, or personal experience;
- I have the right to submit the Submission and to grant the rights described in this Release;
- The Submission does not knowingly infringe or violate the rights of any third party, including copyright, trademark, privacy, publicity, confidentiality, or contractual rights;
- The Submission does not contain material that I am legally prohibited from disclosing; and
- If the Submission includes the name, story, voice, likeness, image, or personal details of another person, I have either obtained permission to include that material or understand that the Company may choose to edit, anonymize, fictionalize, or omit such material.
7. Personal Stories Involving Others
I understand that stories of love and loss may involve family members, friends, partners, loved ones, deceased individuals, or other third parties. I agree that I am solely responsible for the content I choose to submit.
The Company may, in its discretion, remove identifying details, change names, fictionalize elements, combine stories, or otherwise modify the Submission to protect privacy, improve clarity, or serve creative, legal, editorial, or production needs.
8. Release of Claims
To the fullest extent permitted by law, I release and discharge the Company from any and all claims, demands, actions, liabilities, damages, costs, and expenses of any kind arising out of or relating to the Submission or the Company’s use of the Submission, including without limitation claims for invasion of privacy, violation of right of publicity, defamation, false light, emotional distress, copyright infringement, breach of implied contract, or any claim based on editing, alteration, fictionalization, omission, or use of the Submission.
9. Similar Ideas and Independent Creation
I understand that the Company and its creative partners may already have developed, received, acquired, or may in the future develop, receive, or acquire materials, ideas, stories, themes, characters, dialogue, scenes, concepts, or other creative elements that are similar or identical to elements contained in my Submission.
I agree that I will not be entitled to any compensation, credit, ownership, approval, or other rights because of any similarity between my Submission and any existing or future materials created, acquired, used, or exploited by the Company.
10. Opt-Out and Withdrawal
I understand that I may opt out of future communications in the manner described in the campaign’s applicable text message, email, voicemail, website, or terms and conditions language.
However, I understand and agree that opting out of future communications does not revoke the rights already granted in this Release and does not require the Company to remove, recall, destroy, edit, or stop using any materials already created, published, distributed, or prepared using my Submission.
11. Privacy
I understand that the Company may collect and use my contact information and Submission for purposes related to receiving, reviewing, managing, documenting, producing, promoting, and exploiting the campaign, the Picture, and related materials, subject to any applicable privacy policy or terms and conditions made available by the Company.
12. Binding Effect
This Release is binding upon me and my heirs, representatives, successors, licensees, and assigns. The rights granted to the Company may be assigned, licensed, or transferred in whole or in part to any distributor, broadcaster, streaming platform, production partner, financier, marketing partner, purchaser, successor, or other third party.
13. Governing Law
This Release shall be governed by the laws of the State of California, without regard to conflict of law principles, unless otherwise required by applicable law.
14. Acknowledgment
By submitting my Submission, checking a consent box, texting a keyword or message, leaving a voicemail, uploading material, emailing the Company, or otherwise participating in the campaign, I acknowledge that I have read, understand, and agree to this Story Submission Release.
I understand that my Submission may be used by the Company in connection with If You Should Leave Before Me and related materials, and that I will not receive compensation or approval rights for such use.
